1. Agreement to Terms

By accessing or using JsDigital's services, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access our services.

These terms apply to all visitors, users, and others who access or use the service.

2. Services Provided

JsDigital provides the following services:

• Custom PC building and assembly
• Website development and design
• IT support and troubleshooting
• Computer repair and maintenance
• Server setup and maintenance

All services are subject to availability and are provided on an as-quoted basis. Quotes are valid for 30 days from the date of issue unless otherwise specified.

3. Custom PC Builds

3.1 Quotes and Pricing

All custom PC build quotes are based on current market pricing for components. Prices may fluctuate based on component availability and market conditions. Final pricing will be confirmed before order acceptance.

3.2 Component Selection

While we provide recommendations based on your requirements, final component selection is subject to availability. We reserve the right to substitute components with equivalent or superior alternatives if the originally specified parts become unavailable.

3.3 Build Timeline

Standard build time is 5-10 business days from order confirmation. This timeframe may vary depending on component availability and build complexity. We will notify you of any delays.

3.4 Pickup Only

3.5 Testing and Quality Control

All builds undergo 48-hour burn-in testing including stress tests on CPU, GPU, RAM, and storage. Systems are delivered with Windows 11 installed, drivers configured, and a benchmark report.

4. Payment Terms

4.1 Deposit

A 50% deposit is required to commence work on custom PC builds. The deposit is non-refundable once component ordering has begun.

4.2 Final Payment

The remaining balance is due upon completion and before pickup. We accept bank transfer, cash, and major credit cards.

4.3 Payment for Other Services

Website development and IT support services require a 50% deposit to commence work, with the balance due upon project completion or on agreed milestone dates.

5. Warranties and Returns

5.1 Component Warranties

All components are covered by their respective manufacturer warranties. We are not responsible for manufacturer warranty claims, but we will assist in facilitating warranty processes where possible.

5.2 Workmanship

Our assembly and build work is guaranteed against defects in workmanship. If a build issue arises due to our assembly process, we will rectify it at no additional charge.

5.3 No Returns on Custom Builds

5.4 DOA (Dead on Arrival) Components

If a component is found to be defective within 7 days of pickup, we will replace it under manufacturer warranty at no additional cost for labor.

6. Limitation of Liability

JsDigital shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services.

Our total liability for any claim arising out of or relating to these terms or our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

We are not responsible for:

• Data loss or corruption
• Incompatibility with third-party software or hardware
• Damage caused by misuse, accidents, or modifications made after pickup
• Performance issues caused by factors outside our control

7. Website Development Services

7.1 Scope of Work

All website development projects require a signed scope of work document outlining deliverables, timelines, and pricing. Changes to scope may result in additional charges.

7.2 Content and Materials

You are responsible for providing all content, images, and materials required for your website. We are not responsible for delays caused by late or incomplete content provision.

7.3 Intellectual Property

Upon full payment, you own the final website and its content. We retain the right to use the project in our portfolio and marketing materials unless otherwise agreed in writing.

7.4 Revisions

The number of revision rounds is specified in your project quote. Additional revisions beyond the agreed scope may incur additional charges.

8. IT Support and Repair Services

8.1 Diagnosis and Quotes

Diagnostic fees may apply for repair services. This fee will be credited toward the final repair cost if you proceed with the quoted work.

8.3 Parts and Labor

Repair quotes include parts and labor unless otherwise specified. Quotes are valid for 7 days and subject to part availability.

9. Cancellations and Refunds

9.1 Customer Cancellation

If you cancel a custom PC build after components have been ordered, you will be charged for any components that cannot be returned, plus a restocking fee of up to 20%.

9.2 Website Development Cancellation

If you cancel a website development project, you will be charged for work completed up to the point of cancellation based on the agreed milestone schedule.

9.3 Our Right to Cancel

We reserve the right to cancel or refuse service at any time. In such cases, we will refund any payments made, less any work already completed or components already ordered.

10. Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy. By using our services, you consent to such processing and warrant that all data provided by you is accurate.

We will never share your personal information with third parties except as required for service delivery (e.g., shipping, payment processing) or as required by law.

11. Indemnification

You agree to indemnify and hold JsDigital harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your breach of these Terms and Conditions
• Your violation of any law or the rights of a third party
• Your misuse of our services or products

12. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

We will make reasonable efforts to notify you of material changes to these terms.

13. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of New South Wales.

14. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
